1. Who we are
Palatia is a memory-training app published by Palatia. By creating an account or using the app, you agree to these Terms.
2. Accounts
You can use Palatia as a guest (a server-side account tied to a token stored on your device) or as a registered user with an email and password. Guest progress is stored on our servers and may be lost if you uninstall the app or clear app data without first converting the guest into a registered account. You are responsible for keeping your login credentials secure.
3. Acceptable use
Don't use Palatia to: (a) reverse-engineer, scrape, or attempt to disrupt the service; (b) automate gameplay or manipulate leaderboards; (c) access another person's account without permission; or (d) violate any applicable law. We may suspend or terminate accounts that do.
4. Subscriptions and purchases
The current release of Palatia is free of charge. If we introduce optional "Pro" subscriptions or other in-app purchases in a future release, they will be billed through Apple or Google according to their store rules. Renewals, refunds, and cancellations will be governed by the platform you purchased on. We do not store your payment card. See the relevant Apple or Google support pages for refund policies.
5. Content and IP
The app, its design, copy, lessons, and the curated picture library are owned by Palatia or its licensors and protected by copyright. You receive a personal, non-transferable, revocable license to use them inside the app. You may not redistribute or republish them.
6. Service availability
We aim to keep the app running, but we don't guarantee uptime. We may add, change, or remove features at any time. Scheduled maintenance and outages happen.
7. Events beyond our control
Palatia is not liable for any failure or delay in providing the app caused by events outside our reasonable control, including acts of God, war, civil unrest, government action, network or power outages, cyber-attacks, or failures of third-party infrastructure providers (such as our hosting, database, or payment processors).
8. Disclaimer
The app is provided "as is". To the maximum extent permitted by law, Palatia disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. Memory training results vary and we don't promise specific outcomes.
9. Limitation of liability
To the maximum extent permitted by law, Palatia is not liable for any indirect, incidental, special, or consequential damages, or for lost profits, lost data, or lost goodwill arising from your use of the app. Our total liability for any claim related to the app is limited to the amount you paid us in the 12 months before the claim.
10. Termination by you
You can stop using the app at any time. Registered users can sign out from the profile screen; guests can delete their account from the same screen. We may also suspend or terminate accounts that violate these Terms. Upon termination, your right to use the app ends, but provisions that by their nature should survive (IP, disclaimers, limitation of liability, governing law) will survive.
11. Discontinuation of the service
We may suspend or permanently discontinue Palatia, in whole or in part, at any time, with or without notice, for any reason or no reason. If we discontinue the app, we may, but are not obligated to, provide advance notice or a means to export your data. We are not liable for any loss of data, gameplay progress, or unused subscription time resulting from discontinuation, except where mandatory consumer-protection law requires otherwise (in which case our liability is limited as set out in Section 9). Any unused portion of an active subscription will be refunded only to the extent required by the rules of the platform (Apple App Store or Google Play) from which it was purchased; refunds for subscriptions and in-app purchases are processed by those platforms, not by us.
12. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above will reflect the most recent change. Continued use after a change constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the app will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. If you live in a jurisdiction whose consumer-protection laws grant you mandatory rights that cannot be waived, nothing in this section overrides those rights.
