1. Who we are
Palatia is a memory-training app published by Palatia. By creating an account or using the app, you agree to these Terms.
2. Accounts
You can use Palatia as a guest (a server-side account tied to a token stored on your device) or as a registered user with an email and password. Guest progress is stored on our servers and may be lost if you uninstall the app or clear app data without first converting the guest into a registered account. You are responsible for keeping your login credentials secure.
3. Acceptable use
Don't use Palatia to: (a) reverse-engineer, scrape, or attempt to disrupt the service; (b) automate gameplay or manipulate leaderboards; (c) access another person's account without permission; or (d) violate any applicable law. We may suspend or terminate accounts that do.
4. Subscriptions and purchases
Optional "Pro" subscriptions and any in-app purchases are billed through Apple or Google according to their store rules. Renewals, refunds, and cancellations are governed by the platform you purchased on. We do not store your payment card. See the relevant Apple / Google support pages for refund policies.
5. Content and IP
The app, its design, copy, lessons, and the curated picture library are owned by Palatia or its licensors and protected by copyright. You receive a personal, non-transferable, revocable license to use them inside the app. You may not redistribute or republish them.
6. Service availability
We aim to keep the app running, but we don't guarantee uptime. We may add, change, or remove features at any time. Scheduled maintenance and outages happen.
7. Disclaimer
The app is provided "as is". To the maximum extent permitted by law, Palatia disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. Memory training results vary and we don't promise specific outcomes.
8. Limitation of liability
To the maximum extent permitted by law, Palatia is not liable for any indirect, incidental, special, or consequential damages, or for lost profits, lost data, or lost goodwill arising from your use of the app. Our total liability for any claim related to the app is limited to the amount you paid us in the 12 months before the claim.
9. Termination
You can stop using the app at any time. Registered users can sign out from the profile screen; guests can delete their account from the same screen. We may suspend or terminate accounts that violate these Terms. Upon termination, your right to use the app ends, but provisions that by their nature should survive (IP, disclaimers, limitation of liability, governing law) will survive.
10. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above will reflect the most recent change. Continued use after a change constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which Palatia is established, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction. (Specific jurisdiction to be confirmed before launch.)
